Terms of Service

1. Acceptance of Terms

By creating an account or using the KlarSpec platform ("the Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a company, you represent that you have the authority to bind that entity to these terms.

2. User Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials. KlarSpec utilizes secure authentication protocols (including Argon2 and JWTs), but you remain liable for all activities occurring under your account. You must notify us immediately of any unauthorized use.

4. Website Builder & AUP

By using the KlarSpec website builder, you agree not to host content that is illegal, defamatory, infringes on IP, or contains malware. KlarSpec reserves the right to terminate accounts that violate this policy.

5. Domain Management

You retain ownership of your domain. You are responsible for renewals. KlarSpec is not liable for lost domains due to failed payments.

6. Data Ownership

You retain full ownership of all inspector-generated content and client data. KlarSpec retains all rights to the SaaS platform, codebase, and proprietary designs.

8. Free Trials

KlarSpec may offer a free trial period at its discretion. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends. KlarSpec reserves the right to modify or discontinue trial offers at any time without notice.

9. Termination

KlarSpec may suspend or terminate your account at any time, with or without notice, for violations of these Terms, non-payment, or any other reason at our sole discretion. You may cancel your account at any time via your account settings.

Upon termination, your access to the Service will cease immediately. Your data will be retained for up to 60 days, after which it will be permanently deleted. You may request an earlier deletion by contacting support@klarspec.com.

10. Indemnification

You agree to indemnify, defend, and hold harmless KlarSpec, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) any inspection report generated through the platform; (c) any claim by a third party (including your clients or homeowners) relating to your use of KlarSpec; or (d) your violation of these Terms.

11. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use KlarSpec. By creating an account, you represent that you meet these requirements.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration in Salem, Utah, except that either party may seek injunctive relief in a court of competent jurisdiction.

13. Modifications to These Terms

KlarSpec reserves the right to modify these Terms at any time. We will notify you of material changes via email or an in-app notice. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you disagree with any changes, you must stop using the Service and cancel your account.

14. Relationship of Parties

The relationship between KlarSpec and you (the Inspector) is that of independent service provider and customer. Nothing in these Terms creates an employment relationship, partnership, joint venture, or agency relationship between the parties.
